TYPES OF CHANGES

Technical Corrections correct inconsistencies between the existing use of land, land use designation, and/or zoning. They are largely administrative and are intended to better reflect existing uses on the ground.

Design and Use Changes consist of a change in regulations related exclusively to design and use, established through a zone change that applies the proposed CPIO regulations and does not increase allowable densities, intensities, or heights. They require compliance with design regulations and limitations on certain uses that are in addition to current zoning requirements.


Active Change Areas consists of a combination of land use designation changes and/or zone changes that may allow for an increase in currently permitted residential density, height limits, and/or uses. All Active Change Areas include the application of the CPIO, which establishes new development standards to improve the design of new buildings and restrictions on certain uses such as liquor stores and pawn shops, as well as incentives for targeted uses such as affordable housing and grocery stores. Two types of Active Change Areas are proposed as described below.

Active Changes create consistency with existing and surrounding uses, zoning, or land use designations. Although they technically may include an “upzone” and/or “uplan,” there is no increase in allowable square footage or floor area ratio (FAR), and the existing allowable FAR of 1.5:1 will be retained.

Active Changes-Height District 2D are changes to land use designations and/or zoning in targeted areas near transit to create opportunities for more jobs and housing near transit. These changes include an upzone (from Height District 1, 1L, 1VL, or 1XL) to Height District 2D, incentivizing targeted uses by increasing the maximum permitted height and FAR. Active Changes-Height District 2Ds are exclusively located within the TOD Subareas of the CPIO.
